  1. GENERAL
    • ALLYOUNG INTERNATIONAL reserves the right to amend these terms and conditions at any time, in ALLYOUNG INTERNATIONAL’s sole discretion, by posting any such amendment(s) to ALLYOUNG INTERNATIONAL website without prior and separate notice.
    • Your continued use of the site or any part of it after amendment to these terms and conditions is posted will be deemed as full knowledge and acceptance of the revised terms and conditions. If you do not agree to any such term(s), please refrain from using this website
    • In event there exists a conflict between the English version and the Mandarin version of these terms and conditions, the English version shall prevail.
    • The term 'ALLYOUNG INTERNATIONAL' or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ refers to the user or viewer of our website.
  1. ELIGIBILITY
    • To place an order with ALLYOUNG INTERNATIONAL, you must be over eighteen (18) years of age. If you are under eighteen (18), you may place an Order with ALLYOUNG INTERNATIONAL only with involvement of a parent or guardian.
  1. PROHIBITION
    • You must not misuse this website. You shall not commit or encourage a criminal offence, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on the website which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the ordering; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s propriety rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or accessed throughout the website. Any breach of this provision would constitute an offence under Section 233 of the Communications and Multimedia act 1998. In the event such breach occurs, ALLYOUNG INTERNATIONAL will report the breach to the relevant law enforcement authorities and appropriate legal action will be taken
  1. REGISTRATION AND ACCOUNT SECURITY
    • You are required to register before placing any order through our website. You must only submit to us information which is accurate and true. If there are any changes you would like to make regarding your information, please inform immediately through our Customer Service Hotline +603 2242 1896.
    • You must not share your username and password with others or third parties.
    • You authorize us to assume that any person using our website with your username and password is either you or someone who is authorized to act on your behalf.
    • If there is any unauthorised login of your account, please notify us immediately.
    • If any liable order is made under your login, you agree to indemnify us for all claims, or damages made by any third party arising from the actions of a person placing orders through this website using your login.
    • If there is any unauthorised login of your account, please notify us immediately.
    • You shall not misuse the Site by creating multiple user accounts
    • We reserve the rights to refuse any registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
  1. PRICE AND PRODUCT
    • We strive to ensure that our prices, stock, details and sizes of products are reflected accurately on our website. The prices displayed are subject to change without any prior notice. In the event there is insufficient stock, we reserve the right to offer alternative product/s to the you of similar value and range.
    • If we discover an error in the price of any products which you have ordered we will inform you of this as soon as possible and will give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel your order before we have shipped it to you, and you have already paid for your order, you will receive a full refund.
    • We are under no obligation to fulfil your order if the price listed on the website is incorrect (even after your order has been acknowledged by us).
    • You can pay using any of our payment partners listed on our homepage or use the cash on delivery payment method. Similarly, you can pay all or part of the price of your order using a store credit or promotional voucher.
    • To minimise the risk of unauthorised access, we encrypt your card’s data. Once we receive your order, we will request a pre-authorisation on your card to ensure there are sufficient funds available to complete the transaction. Order will not be confirmed until this pre-authorisation check has been completed. Your card will be debited once we have sent you the order confirmation. Cards are subject to validation checks and authorisation by card issuer. If we do not receive the required authorisation, we will not be liable for any delay or non-delivery.
    • Upon authorisation of the payment, by clicking the “Order now” button you are confirming that the card belongs to you or that you are the legitimate holder of the promotional voucher, and have sufficient funds or credit facilities to cover the cost of the product.
    • The prices displayed on our website may vary from the prices displayed in third parties’ offline & online stores.
    • The prices charged to you are valid only on the day that you purchased your order.
    • All orders are subject to our confirmation according to stock availability and we reserve the right to reject the order in the event that any of the products or services requested is unavailable. In the event that we are unable to fulfil any of the products or services in your order, we will notify you by phone or email.
    • All pictures and images of the products displayed on our website are for illustration purposes only. The actual size, dimension and colour of the products may differ.
  1. ONLINE ORDER
    • Once you have selected a product that you wish to order via www.allyoung.com.my, you will then be shown (on the website) the charges you must pay including taxes, if applicable, and any applicable delivery charges.
    • We are not obliged to supply the product to you until we have accepted your order. An order shall be formed and we shall be legally bound to supply the product to you when we accept your order. Acceptance shall take place when we expressly accept your order by email to you, in the form of a document called a "Confirmation of Order" stating that we are accepting your order.
    • During the order reviewing process, we reserve the right to refuse to process your order and you reserve the right to cancel your order.
  1. PAYMENT TERMS
    • We accept payment made by Visa, MasterCard, Maybank2U, American Express and Point Redemption.
    • All product prices listed are in Ringgit Malaysia (RM).
    • To provide secure online commerce transactions, we employ Internet's Secure Sockets Layer (SSL) technology. It encrypts your personal information, including your credit card number, name and address, so that it would be unreadable as it travels through the Internet. To check for SSL Certificate, you can right click the mouse and choose "Properties" & "Certificates".
    • We reserve the right to set a certain credit limit for certain customers and to limit any sales to certain customers. This includes the right to decline sales from the customers.
    • Full payment must be made upon the placing of the order. If your payment cannot be processed, your order will be not be accepted. You are advised to contact your card issuer to resolve the issue concerning the use of your credit card in order to continue with the order.
    • We reserve the right to change the payment terms at any time without prior notice.
    • If the payment for has already been made but the order is not accepted by us, you will be entitled to a full refund depending on the period of time your financial institution required to arrange for the refund. We shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.
  1. VOUCHERS
    • You may use promotional vouchers while making payment for products on the website. Specific details for promotional vouchers are listed below.
    • Promotional vouchers must be entered at the checkout page online only.
    • Physical presentation of vouchers to ALLYOUNG INTERNATIONAL personnel will not be accepted.
    • In the event of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with redemption of that voucher on the webite, we are entitled to close your account and/or require a different means of payment.
    • We assume no liability for the loss, theft or illegibility of gift or promotional vouchers.
    • In rare cases, ALLYOUNG INTERNATIONAL may at its sole discretion discontinue or cancel any voucher previously issued and will not be responsible for any losses arising therefrom.
    • Conditions for the redemption of promotional vouchers:
    • From time to time we may distribute promotional vouchers that may be used only on the webite, which we will send to you either by email or post:
      1. Promotional vouchers are valid for the specified period stated on the voucher, can only be redeemed once and may not be used in conjunction with other promotional vouchers and discounted items.
      2. You may redeem only ONE voucher per promotional campaign. ALLYOUNG INTERNATIONAL reserves to the right to cancel any subsequent orders made by you using a voucher of the same promotional campaign.
      3. If you place an order for a product less than the value of the promotional voucher, no refund or residual credit will be returned to you.
      4. The credit of a promotional voucher does not accrue interest nor does it have a cash value.
      5. If the credit of a promotional voucher is insufficient for the order you wish to place, you may make up the difference using one of our accepted payment methods.
      6. For cash vouchers stipulated for a RM xx sum, if you choose to return the product, you will not be refunded the value of the cash voucher. However, if you paid partly with your own funds, this portion will be refunded.
  1. GOODS DELIVERY
    • We reserve the right to withhold the delivery of the products to you if we have doubts regarding your credit status or personal details.
    • We will deliver the products to the delivery address specified and keyed in by you in the order form. Your order will be delivered to you via a courier service company appointed by us.
    • We aim to deliver within the time frame indicated below but we do not guarantee the exact delivery dates upon order. To the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
  1. LOCATION

    • Upon delivery of the product, you are required to sign for delivery. Please examine the goods immediately upon collection for any deficiencies and/or damages before you sign for delivery. Any risks will be passed to you upon delivery. All the risks in the product shall be passed to you upon delivery. From the time when risk passes to you, we will not be liable for loss or destruction of the product. Any breach of obligations by you, might impact your ability to shop on our website in the future
    • If you are not available to take the delivery, we may leave a card giving you instructions on either re-delivery or collection from the carrier.
    • Please note that it might not be possible for us to deliver to some locations in which event, we will inform you using the contact details that you provide to us when you make your order and arrange for cancellation of the order or delivery to an alternative delivery address.
    • If delivery is delayed through your unreasonable refusal to accept delivery or if you do not (within two weeks of our first attempt to deliver the product to you) accept delivery then we may (without affecting any other right or remedy available to us) do either or both of the following:
      1. charge you for our reasonable storage fee and other costs reasonably incurred by us; or
      2. no longer make the product available for delivery and notify you that we are immediately cancelling the order, in which case we will refund to you or your credit card company as applicable any money already paid to us under the order, less our reasonable administration charges (including for attempting to deliver and then returning the product, and any storage fees as provided).
    • It is your responsibility to notify us immediately of any change to your delivery address.
    • We reserve the right to decline delivery of goods to any customer at our sole discretion.
  1. CANCELLATION
    • We may cancel an order if the product ordered is not available. We will notify you if this is the case and return any payment that you have made. Refund will be credited into customer's credit card account depending on the period of time your financial institution required to arrange for the refund.
    • If you wish to cancel your order please contact our Customer Service Hotline +603 2242 1896. No cancellation fees shall be applicable. Once an order has been dispatched it may not be cancelled and the item must instead be returned to the company according to guidelines provided by the Customer Service Team (Please call the above stated number or refer to your return-slip provided in your received parcel).
    • You are not allowed to cancel the order once a Confirmation of Order has been issued.
  1. RETURN / REFUND
    • You have to examine the products immediately upon receiving it for any deficiencies and/or damages. Claims (if any) must be lodged to our Customer Service Hotline +603 2242 1896 at the time of collection/delivery; otherwise we have the rights to refuse your claim.
    • For product that is found to be defective and/or is damaged upon your inspection, you may return the defective product(s) to us. You have to present a valid receipt of the purchase for us to accept your return.
    • Exchange of the product or refund for the product can only be arranged if one of to the following reasons is met:
      1. If the product is expired/damaged upon arrival
      2. If the product ordered differs from the item delivered.
    • All items must be received by ALLYOUNG INTERNATIONAL in order for a customer to be eligible for a refund or replacement. You shall ensure that the product is sent to us in the same condition as it was when received by you and is packaged properly. In the event that an item is returned to us in an unsuitable condition, we reserve the right not to accept returns and send the product back to you.
    • If one or more of the conditions in paragraph 12.3 above is fulfilled, you are entitled to choose between an exchange of the product (if the product is still available in our stock), or a refund to be made to you through the Customer’s payment account (credit card/debit card/point redemption), after 30 days from the approved return date.
    • Refund will be credited according to the price which you had paid at the point of ordering.
    • In the event the product returned is not faulty, we may at our discretion decide not to replace or refund you for the product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

    • Kindly refer to our Privacy Policy which forms a part of these Terms and Conditions.
  1. APPLICABLE LAW 
    • These Terms and Conditions is governed by and construed in accordance with the laws of Malaysia and any disputes will be resolved exclusively only by the Courts of Malaysia.
  1. DISCLAIMER
    • By accessing and using www.allyoung.my, you acknowledge and accept that the use of the site is at your own risk. We shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for lost profits or for loss of revenue arising out of any use of, access to, or inability to use the site, subject to the rights under the consumer protection law and to the fullest extent permitted by law.
    • To the extent permitted by law, this site and all information and materials contained in it are provided “As Is” without any warranty of any kind either express or implied including but not limited to any implied warranties or implied terms as to title, quality, merchantability, fitness for purpose, privacy or non-infringement. We are not liable or responsible for any errors or omissions in the contents of the site, to the extent permitted by law. We assume no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of any use of or access to the site/catalogue, or any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software  or hardware problems (including without limitation loss of data or compatibility problems), theft, destruction or alteration of the site, whether for breach of contract, tortious behaviour, negligence or, under any other cause of action resulting directly or indirectly from any access or use of the site/catalogue, or any uploading, downloading or publication of data, text images or other material or information to or from the site.
